Independence Of The Judiciary And Its Effectiveness In The Dispensation Of Justice. Case Study: Kenya

ABSTRACT

The study was aimed at establishing the independence of the judiciary and its effectiveness in the

dispensation of justice.

During the research, the following objectives were to be studied: to analyze the independence of

the judiciary, the rule of law and the doctrine of separation of powers.

The variables were tested using both primary data from the field and secondary data from

physical books and internet and other literature.

The study was both significant to the researcher, judiciary, government and then general public.

The researcher found that judicial independence is important in the dispensation of justice.

Therefore, the finding of the study showed that judicial independence is not strictly observed and

therefore this affects the performance of the judiciary.

It is recommended that, the principle of separation of powers be upheld as provided for in the

constitution of the Republic of Kenya 2010.This therefore will create an independent judiciary so that justice is administered without fear, favour and or ill will.
