ABSTRACT The research examined the dilemma and challenges of death penalty in Uganda taking a case study of Susan kigula case and 4 7 others vs Ag. The research was guided by three objectives to fully carry out in-depth analysis of the study. The objectives were; To examine the Supreme Court orders in Kigula case in the light of situation in Uganda today, to asses whether death penalty achieves its purported objectives of retribution and deterrence and to establish a case against abolition of mandatory death penalty and hence. The research employed a case design were qualitative data on the research was collected. The research drew most of the reference from the case of Susan kigula conceming death penalty. The study relied on mainly the secondary sources of data from news papers, journal and books relevant to the topic. The research revealed that Punishment by its nature must inflict some pain and unpleasantness, physical or mentally to achieve its objectives. The framers of the Judgement forget about the lives and rights of the victims thereby posing a conflict that has made people to turn to mob justice because a jail sentence of life is no longer deterrent. A death sentence is something that cannot be forgotten so easily and so quickly? A death sentence is not merely designed to remove from this earth, blissfully and peacefully, those people who have committed heinous crimes like murder, genocide and crimes against humanity. It is an Exception to article 24 and all parliament has to do is provide a balanced method of carrying it out between blissful and peaceful method of dispatch, like the lethal injection and more barbaric methods. The research recommends that from the example of the case of Bwengye, I recommend a need to review the decision in kigula case so that instead of remitting files to be heard on mitigation to the High Court, the normal appeal process is followed to save judges the agony of passing death sentence.
