Investigating The Extent Of Provision For Human Rights In Kenya's Succession Laws And Policies

ABSTRACT

The study highlights the interplay between land laws and laws governing succession

and human rights dispensation in the application of the legal norms, focusing on how

the practices on land ownership influence the enjoyment of succession rights in Kenya.

The land and succession laws are municipal in nature; they have great ramifications in

relation to the fulfillment of national obligations in international human rights law, and

are influenced by the provisions pertaining to both civil and political rights as well as

economic, social and cultural rights as herein discussed.

This research is arranged in five parts discussing the issues relating to land and

succession rights in Kenya, how they are implemented and how they can be improved.

This research is focused on finding out the constraints of the enjoyment of human

rights when it comes to succession of land in Kenya. It will investigate the rights

embedded on the succession laws as well as make appropriate recommendations that

will help improve the challenges faced in the law of succession in Kenya. This research

has been carried out using libraries, textbooks, journals, resource centres and the

internet to obtain information.

This research has also come up with ways to improve the rights of people when it

comes to succession and this is by consolidating the already existing laws, amending

the land laws, resettling the squatters, educating the public about their rights and getting more assistance from human rights bodies.
