The article was published in Jamia Law Journal Vol. 4 in 2019 by Dr. Mohammad azwar khan. The author talks about the very controversial law “Sedition” which falls under section 124 A of the Indian Penal Code. Sedition law is said to be a colonial-era relic by the author and is considered vague and broad. Sedition in simplest terms is defined as “any act or speech that leads to insurrection against the state”.
This article talks about various aspects of and about sedition law in India like - How sedition laws are interpreted and executed. How Sedition evolved and what was the stance of state regarding it. A comparative study between Pre independence and post-independence. Evolution and historical background of sedition. The landmark judgements and precedents given by Honourable Courts that changed the law of sedition and how they are still being used.
In addition to this the writer of this article also portrays his view on how Sedition law has been misused since long time and is used to supress the liberty of genuine critiques. The law is called as cruel in nature and stand against India’s tolerant stance and against international human rights law. The broadness and vagueness of this law makes it a very convenient tool to stifle voice of genuine dissent and violates the basic structure of Indian constitution, right to freedom of speech
Furthermore, the author supports his arguments with official data from the year 2017 and concludes with a distinction between what should and what should not be considered as sedition.
